Under South Carolina law, only the Personal Representative of a decedent’s estate is authorized to bring claims for survival and wrongful death on behalf of someone who has passed away. To be appointed as a Personal Representative, you must file a Petition with the appropriate Probate Court. Even someone designated as executor in a will must complete this process to serve as a Personal Representative in a survival or wrongful death suit.
